Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the services, websites, digital tools, assessments, and related materials provided by Insight Psychological Inc. (“Insight Psychological,” “Insight,” “we,” “our,” or “us”). By using any of our Uses or accessing our website, you agree to be bound by these Terms.

If you do not agree to these Terms, you must discontinue use of our services, products, and website.

1. Scope of Services

Insight Psychological provides:

  1. Clinical Services:
    Counselling, psychological assessments, mental health case consultation, psychoeducation, group therapy, and critical incident support delivered by licensed or supervised mental health practitioners. 
  2. Workplace Assessment Services:
    Including the PsyRisk Analytics Workplace Psychosocial Risk Assessment, MyPsychPulse Mental Health Scan, and related organizational reports and dashboards. 
  3. Digital Platforms and Tools:
    Survey and assessment systems, online booking, virtual care platforms, and associated websites and applications.

These services are not emergency or crisis services. If you are in crisis, call 911 or your local emergency service immediately.

2. Eligibility and Use

2.1 Clinical Services

Individuals must be 18 years of age or older, or have parental/guardian consent where permitted under applicable laws and professional regulations.

2.2 Workplace Services

For employer-sponsored assessments, use is limited to approved participants designated by the contracting organization.

2.3 Capacity

By accessing our services, you confirm that you have the legal capacity to enter into these Terms.

3. Nature and Limitations of Services

Insight Psychological provides professional services intended to support mental wellness; however:

  • Clinical services do not replace medical or emergency care.
  • Individual formal assessments are based on the information available at the time and are intended for the specific purposes outlined in the assessment; they may not predict future behaviour or outcomes and should not be used beyond their stated scope.
  • PsyRisk Analytics, MyPsychPulse, and all workplace assessments provide awareness and aggregate insights only and do not constitute clinical diagnoses, medical advice, or individual psychological treatment.
  • No guarantee can be made regarding therapeutic or organizational outcomes.

4. Workplace Assessment Terms

4.1 Organizational Responsibilities

Organizations contracting workplace services are responsible for:

  • Ensuring voluntary participation of their intended members
  • Communicating the purpose and process of assessments
  • Ensuring organizational readiness and compliance with occupational health and safety obligations
  • Using results appropriately and in accordance with applicable laws

4.2 Assessment Participants

For all workplace assessments:

  • Participation is voluntary
  • Individual responses are not disclosed to the organization
  • Only aggregated, de-identified results meeting minimum group-size thresholds are provided
  • Open-ended identifying information may be redacted or excluded

4.3 Assessment Integrity

Insight may refuse or modify custom questions that request identifying information, are discriminatory, or compromise validity or privacy requirements.

5. Fees and Payment

5.1 Clinical Services

Fees vary depending on the practitioner and service type. Fee information will be provided before the start of service. Clients are responsible for payment regardless of insurance reimbursement.

5.2 Workplace Assessment Services

Fees are governed by the contract between Insight and the organization.

5.3 Non-Payment

Insight may suspend or deny services for unpaid balances.

6. Intellectual Property

All materials, tools, software, assessments, manuals, reports, and website content—including PsyRisk Analytics, MyPsychPulse, and associated materials—are the exclusive property of Insight Psychological or its licensors.

You may not:

  • Copy, modify, reproduce, distribute, or republish any materials
  • Reverse engineer, decompile, or tamper with software or digital tools
  • Use the content for any commercial purpose without written permission

Limited, revocable permission is granted to access materials solely for personal or authorized organizational use.

7. Electronic Communication and Technology

7.1 Electronic Communication Risks

Email, text messaging, and other electronic communication may not be fully secure. By communicating electronically, you acknowledge these risks.

7.2 Third-Party Platforms

Insight uses secure third-party vendors, which may include:

  • Jane and Heidi Health (clinical booking, records, payment)
  • SurveyMonkey, ClicData, Brilliant Assessments (survey and analytics platforms)
  • Google Analytics and cookies (website analytics)

Use of these platforms is subject to their respective terms and privacy policies.

8. Privacy and Confidentiality

Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.

Clinical personal health information is protected under applicable privacy legislation, including Alberta’s Health Information Act (HIA) and Personal Information Protection Act (PIPA).

Workplace assessment data is de-identified and aggregated before disclosure to organizations.

9. Disclaimers and Limitation of Liability

9.1 No Warranties

Services are provided “as is” without warranties of any kind, express or implied.

9.2 No Guarantee of Outcomes

Insight does not guarantee:

  • Resolution of clinical concerns
  • Organizational changes or risk reduction
  • Accuracy or completeness of the assessment results provided – as they are based purely on participants’ responses at a particular time.  

9.3 Limitation of Liability

To the extent permitted by law, Insight Psychological’s total liability for any claim arising from the services shall not exceed the total fees you paid for the services giving rise to the claim.

Insight is not liable for:

  • Indirect, incidental, or consequential damages
  • Employment or any other decisions, actions or inactions made by organizations and any outcomes or lack thereof from those decisions, actions or inactions. 
  • Errors or failures caused by third-party software or platforms

10. Modifications to Terms

Insight reserves the right to update these Terms at any time. The updated version will be posted on our website with a revised “Last Updated” date. Continued use of services after changes indicates acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada. Any dispute arising from these Terms or your use of our Services must be brought exclusively before the courts of Alberta. Before starting a legal claim, both parties agree to make reasonable efforts to resolve the issue through good-faith discussion and, if mutually agreed, mediation. Nothing in this section limits our obligations under applicable professional or regulatory requirements.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, all other provisions will nevertheless continue to be valid and enforceable with the invalid and unenforceable parts severed from the remainder of Terms.
